Equitable Life Justice and Compensation
The Parliamentary Ombudsman as we expected has made findings of maladministration on the part of the Government regulators of Equitable Life and recommended that Parliament set up a scheme of compensation. The Government is not expected to respond before the autumn. Once that response is known, we shall consider any possible ways in which we may assist affected policyholders and annuitants.
We are not able at the present time to pass any meaningful comment upon what options may lie ahead. The Government may decide to set up a scheme to consider compensation or it may ignore the findings of the Parliamentary Ombudsman. If a scheme is set up, it is likely that you will need expert advice on how to present your claim in order to maximise any potential recovery. If a scheme is not set up, then we shall advise you as to what legal remedies may exist. We cannot say more at this time. We cannot go into specifics as to eligibility under the scheme or indeed measure of loss.
We do believe that this firm’s unique experience in now dealing with over 600 cases against Equitable Life mean that whatever the outcome of the Government’s response we are well placed to assist current and former Equitable Life policyholders and annuitants. We have particular experience in relation to the with-profits annuity and we certainly feel that the expert evidence we collated during the ELTA case and our extensive background knowledge gleaned over the years from acting against Equitable Life mean we are best placed to assist.

We do feel that there is likely to be a fight to ensure adequate compensation for those affected by the near collapse of Equitable Life despite the damning failures highlighted by the Parliamentary Ombudsman in her report. Please join us in seeking justice for all those who have suffered a loss.
